The issuance of the certificates about the presence or absence of the criminal record in Romania is regulated by the Law No. 209 dated 2004, as well as by the Decree of the Government of the Republic of Romania No. 1373 dated 2004.

In order to prevent and suppress the actions stipulated by the criminal law, the register of the convicts is maintained as the source of information and operational identification of persons who have committed crimes against the persons, their freedom, property; and the rule of law in general.
The administration of the criminal record register is carried out by the General Inspectorate of the Romanian Police.
The General Inspectorate of the Romanian Police organizes and maintains the centralized record of criminal records of legal entities and individuals, including those born outside Romania, as well as foreign citizens who have criminal records, operational and special police records. The records contain information about the crimes committed on the territory of Romania, about the criminal procedural measures imposed, about bringing to administrative responsibility and about the sentences passed. The criminal record in Romania will contain information about the sanctions from the final judgments.
The certificate of the presence or absence of the criminal record issued in Romania is valid for 6 months.
The certificate can be ordered for both the individual and the legal entity. If the individual or legal entity believes that the information in the register of “convicted” is not true or its registration was not made in accordance with the law, this person has the right to demand the correction or deletion of such information. The request for correction must be motivated and accompanied by the supporting documents. The request must be addressed to the police unit that previously issued the criminal record in Romania. The maximum period for considering the request, making changes to the register of "convicted" and issuing of the new certificate (reference) should not exceed 20 days.
